1. About these Terms
These Terms and Conditions (“Terms”) govern your use of the website resonanceart.ch (the “Platform”), operated by Association ResonanceArt, a non-profit association registered in Geneva, Switzerland.
By creating an account, publishing content, buying, selling, donating, or otherwise using the Platform, you accept these Terms in full. If you do not accept them, you must not use the Platform.
2. The Platform
ResonanceArt is a digital platform that connects artists, audiences, and supporters around the celebration of arts and culture, with a special focus on live performance, music, dance, and the therapeutic dimension of the arts.
The Platform allows registered members to:
- Create a personal profile and showcase their work.
- Publish creations on the Market and sell them to buyers.
- Announce events, workshops and gatherings.
- Send private messages to other members.
- Open donation-based campaigns to fund artistic, humanitarian or ecological projects.
- Discover, buy, and support artists from around the world.
3. Account registration
To register on the Platform, you must:
- Be at least 18 years old (or have the explicit consent of a parent or legal guardian).
- Provide accurate, current and complete information.
- Keep your account information up to date.
- Keep your password confidential and never share your account with another person.
- Notify us immediately at info@resonanceart.ch if you suspect unauthorised use of your account.
You may create only one account per person. Fake accounts, impersonation accounts, or accounts used to manipulate the Platform are strictly forbidden and will be deleted without notice.
4. The role of ResonanceArt as a platform
ResonanceArt is a technical platform that connects artists and buyers. We are not a party to the transactions between users. When you buy a creation, you are buying it directly from the artist, not from ResonanceArt.
This means:
- The seller is responsible for the description, quality, shipping, and any after-sales service of their creations.
- The buyer and the seller arrange the practical details of delivery, pickup, or service execution directly between them after a purchase.
- ResonanceArt does NOT mediate disputes, does NOT issue refunds, and does NOT hold the funds. Payments go directly from the buyer to the seller through Stripe.
- ResonanceArt takes 0% commission, because we are a non-profit association.
5. Rules of publication
When you publish content on the Platform (creations, events, profile bio, messages, comments), you confirm that:
- You are the author or the rightful owner of the content, or you have explicit permission to publish it.
- The content does NOT violate any third-party rights (copyright, trademark, image rights, privacy).
- The content is lawful, respectful, and aligned with our Community Charter (see below).
- You grant ResonanceArt a non-exclusive, free, worldwide licence to display and distribute your content on the Platform, for the time it is published, solely for the purpose of operating the Platform. You remain the full owner of your work.
The following content is strictly forbidden and will be removed without notice:
- Hate speech, harassment, discrimination, violence, or threats.
- Sexually explicit content, nudity (outside of artistic context approved by our team), or content endangering minors.
- Counterfeit, stolen, or illegal goods.
- Misleading, fraudulent, or deceptive content.
- Spam, automated content, or content used to artificially inflate visibility.
- Content infringing the intellectual property of others.
- Sexism, racism, nationalism, discrimination based on origin, gender, age, ability, sexual orientation or beliefs.
- Commercial content disguised as artistic content: product launches, brand campaigns, sales pitches with no artistic dimension.
- Esoteric or paranormal content presented as a paid service or commercial offer.
- Alternative medicine presented as a medical treatment.
- Religious content used to proselytise.
6. The Market
The Market section of the Platform allows artists to sell their creations. By publishing a creation for sale, you commit to:
- Describing it accurately, including condition, dimensions, materials, and shipping conditions if applicable.
- Setting a fair price in Swiss Francs (CHF).
- Honouring every confirmed sale: shipping the creation or providing the service within the timeframe you announced.
- Responding to the buyer within 48 hours after a purchase.
- Handling any after-sales matter directly with the buyer.
By buying a creation, you commit to:
- Paying the displayed price in full at the time of purchase.
- Contacting the seller within 48 hours to arrange the practical details.
- Respecting the artist and their work.
All payments are processed by Stripe. ResonanceArt does not store credit card information.
7. Donations
Some artists may launch donation-based campaigns to fund artistic, humanitarian, or ecological projects. By donating, you support the project directly. Donations are not refundable, unless the project is cancelled by the artist or the campaign is closed by ResonanceArt for misuse.
8. Events
Members may publish events. The Platform displays them but does NOT organise, certify, or guarantee them. The event organiser is fully responsible for the event, its safety, its legal compliance, and any ticketing or fees.
9. Intellectual property
All content published by members remains the property of its author. The name “ResonanceArt“, our logo, our visual identity, and the design of the Platform belong to Association ResonanceArt.
10. Suspension and termination
We reserve the right to suspend or delete any account that violates these Terms or our Community Charter, without prior notice and without refund. You may also delete your own account at any time by writing to info@resonanceart.ch.
11. Limitation of liability
ResonanceArt operates the Platform “as is”, and does not guarantee uninterrupted access or absence of errors. To the maximum extent permitted by Swiss law, ResonanceArt cannot be held liable for:
- The actions or omissions of other users (sellers, buyers, donors, organisers).
- The quality, legality or accuracy of content published by members.
- Disputes between users.
- Loss of data, profits, or opportunities related to the use of the Platform.
- Service interruptions due to maintenance, hosting issues, or third-party failures (Stripe, Firebase, Infomaniak).
12. Applicable law and jurisdiction
These Terms are governed by Swiss law. Any dispute relating to the Platform or to these Terms will be submitted to the exclusive jurisdiction of the courts of Geneva, Switzerland, subject to the mandatory provisions of consumer law in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will reflect the latest revision. Continued use of the Platform after changes means you accept the new Terms. Material changes will be communicated to registered users by email.
